Boonan grants users a limited license to use the website Boonan.com under the following Terms and Conditions. By using the website, you agree to accept these Terms and Conditions and agree that use of the website shall constitute proof of your consent to the Terms and Conditions including our Privacy Policy which is herbey incorporated in its entirety hereto, as follows.

Points. Points issued on Boonan.com are for motivational purposes only and currently have no cash value. Points may not be traded with others or used for any commercial or barter purposes without the express written consent of Boonan. Boonan expressly reserves the right to set the point values of different actions that users take on the website or in the real world that they record on the website. The algorithms used by Boonan to determine the point values of one or more actions as well as the total points accrued are the sole property of Boonan and can be changed or altered at any time at the sole discretion of Boonan. Boonan reserves the right to alter points already accorded by means including but not limited to algorithms or mathematical functions that take into account such variables as passage of time, time since last use of the site, location, place or any other factors it may incorporate at its sole discretion.

Photographs and videos. Photos and videos ("media") uploaded or posted to Boonan remain the property of the poster except that, once posted, User hereby grants an irrevocable license to Boonan to display said media on its website, manipulate its size, shape and technical characteristics, share media with other websites or business partners or successor sites or other sites it controls, copy media, store media in memory or otherwise use photos in the course of its business. User warrants and represents that he or she has the right to upload media and license its use to Boonan. In the event media infringe on a copyright, user hereby indemnifies Boonan against all claims and actions originating from its use by and display on Boonan and agrees to defend Boonan in any legal proceedings stemming from said claims or actions. Upon written notice provided to Boonan of copyright infringement, under the safe harbor provisions of the Digital Millenium Copyright Act (the "Act", Boonan will take down said infringing media according to the timetable and provisions set forth in the Act.

Postings, Comments and User Actions. User grants Boonan an irrevocable license to all postings made to Boonanof whatever type, including but not limited to comments, data, text, clickstreams and other user actions ("Postings"), and surrenders all rights to Postings on the site. User understands that Boonan.com is a moderated site and that Boonan may alter, edit, take down or block access to any user comments, Postings, photos, rich media or other material contributed by users for any reason at its sole discretion.

Privacy. Our privacy policy is spelled out on the Privacy page of our website which is accessible at www.Boonan.com/inf/privacy.php and hereby incorporated in its entirety hereto. Children under age 13 are expressly prohibited from providing their personal information to Boonan and use of the site constitutes agreement that you are not under the age of 13 and you understand that the website is not directed at those under 13. Accordingly, Boonan is not directed at children as construed in the Children's Online Privacy Protection Act ("COPPA") nor is Boonan aware of the use of the website by children under 13 without their parent's consent.
